Tugas softskill koperasi



Lahirnya Undang-Undang No. 17 Tahun 2012 menggantikan Undang-Undang No. 25 Tahun 1992 tentang Perkoperasian dinilai memiliki beberapa kelemahan dan mewarisi tradisi perkoperasian kolonial. Salah satu contohnya adalah semangat koperasi dihilangkan kemandiriannya dan disubordinasikan di bawah kepentingan kapitalisme maupun negara. Campur tangan pemerintah dan kepentingan pemilik modal besar sangat terbuka dalam undang-undang ini.

Pasal 1 angka 1 Undang-Undang Koperasi dijelaskan bahwa koperasi adalah badan hukum yang didirikan oleh orang perseorangan atau badan hukum koperasi, dengan pemisahan kekayaan para anggotanya sebagai modal untuk menjalankan usaha, yang memenuhi aspirasi dan kebutuhan bersama di bidang ekonomi, sosial, dan budaya sesuai dengan nilai dan prinsip koperasi. Dari definisi tersebut mengandung makna koperasi sebagai badan hukum yang tidak ada bedanya dengan badan usaha uang lain. Undang-Undang No. 17 Tahun 2012 masih berlandaskan pada azas perseorangan yang hampir sama dengan perusahaan kapitalistik seperti Perseroan.

Selain itu, dalam Pasal 75 Undang-Undang ini yang mengatur soal penyertaan modal tidak mengenal adanya pembatasan. Akibatnya, koperasi bisa kehilangan kemandiriannya dan anggotanya hanya sekadar dijadikan objek pinjaman bagi pemilik modal besar. Bahkan, Pasal 55 semakin mengancam kemandirian koperasi yang membolehkan kepengurusan koperasi dari luar anggota. Keberadaan Dewan Pengawas sebagaimana tercantum dalam Pasal 48 sampai Pasal 54 juga yang berfungsi layaknya lembaga superbody. Hal ini memudahkan keputusan koperasi di luar kepentingan anggotanya.


Undang-Undang No. 17 Tahun 2001 tidak memiliki perbedaan substansial dengan Undang-Undang Perkoperasian era orde baru Undang-Undang No. 25 Tahun 1992 dan Undang-Undang No. 12 Tahun 1967. Secara substansial, Undang-Undang No. 17 Tahun 2012 masih mewarisi karakteristik/corak koperasi yang diperkenalkan di era pemerintahan Soeharto melalui Undang-Undang No. 12 Tahun 1967

Perbedaan mendasar antara Undang-Undang No. 12 Tahun 1967 dengan Undang-Undang No. 14 Tahun 1958 di era pemerintahan Soekarno terletak pada ketentuan keanggotaan koperasi. Dalam Undang-Undang No. 14 Tahun 1958, sebagaimana diatur pada Pasal 18, yang dapat menjadi anggota koperasi adalah yang mempunyai kepentingan dalam lapangan usaha koperasi. Ketentuan ini lebih lanjut menurut Revrisond sejalan dengan penjelasan Mantan Wakil Presiden Moh. Hatta bahwa “bukan corak pekerjaan yang dikerjakan menjadikan ukuran untuk menjadi anggota, melainkan kemauan dan rasa bersekutu dan cita-cita koperasi yang dikandung dalam dada dan kepala masing-masing”.

Pada Undang-Undang No. 12 Tahun 1967 ketentuan keanggotaan koperasi berubah secara mendasar. Hal ini tergambar dalam Pasal 11 bahwa keanggotaan koperasi didasarkan atas kesamaan kepentingan dalam lapangan usaha koperasi. Kemudian, pada Pasal 17 yang dimaksud dengan anggota yang memiliki kesamaan kepentingan adalah suatu golongan dalam masyarakat yang homogen. Perubahan ketentuan keanggotaan yang dilakukan melalui Undang-Undang No. 12 Tahun 1967 ini adalah dasar bagi tumbuhnya koperasi-koperasi golongan fungsional seperti koperasi pegawai negeri, koperasi dosen, dan koperasi angkatan bersenjata di Indonesia.

Undang-Undang Perkoperasi yang terbaru yaitu Undang-Undang No. 17 Tahun 2012 juga mempertahankan keberadaan koperasi golongan fungsional. Pada Pasal 27 ayat (1), syarat keanggotaan koperasi primer adalah mempunyai kesamaan kepentingan ekonomi. Lebih lanjut dalam penjelasn disebutkan bahwa yang dimaksud dengan kesamaan kepentingan ekonomi adalah kesamaan dalam hal kegiatan usaha, produksi, distribusi, dan pekerjaan atau profesi.

Undang-Undang No. 12 Tahun 1967 membuka peluang untuk mendirikan koperasi produksi, namun di Undang-Undang No. 17 Tahun 2012 peluang ini justru ditutup sama sekali. Hal ini terlihat pada Pasal 83, di mana hanya terdapat empat koperasi yang diakui keberadaannya di Indonesia, yaitu koperasi konsumen, koperasi produsen, koperasi jasa, dan koperasi simpan pinjam. Sesuai dengan Pasal 84 ayat (2) yang dimaksud dengan koperasi produsen dalah koperasi yang menyelenggarakan kegiatan usaha pelayanan di bidang pengadaan sarana produksi dan pemasaran produksi. Artinya, yang dimaksud dengan koperasi produsen sesungguhnya adalah koperasi konsumsi para produsen dalam memperoleh barang dan modal

Koperasi diatur berdasarkan Undang-Undang No. 17 Tahun 2012 tentang Perkoperasian. menggantikan Undang-Undang No. 25 Tahun 1992 tentang Perkoperasian dinilai memiliki beberapa kelemahan. Menurut saya undang” perkoperasian yang baru ini juga masih mengalami kekurangan yaitu :

-> Di hilangkannya gerakan kemandiriannya koperasi sehingga anggota hanya sekedar dijadikan objek pinjaman bagi pemilik modal besar.yang terdapat pada pasal 75 Undang” Th 2012 ini yang mengatur soal penyertaan modal dan tidak mengenal pembatasan nilai modal.
->Lalu dalam Undang-Undang No. 17 Tahun 2012 Pasal 83 peluang dalam mendirikan koperasi produksi peluang ini justru ditutup sama sekali. di mana hanya terdapat empat koperasi yang diakui keberadaannya di Indonesia, yaitu koperasi konsumen, koperasi produsen, koperasi jasa, dan koperasi simpan pinjam. yang seharusnya peluang untuk mendirikan koperasi produk ini harus terbuka.
->Kurangnya perhatian dari pemerintah terhadap koperasi yang ada di indonesia sehingga banyaknya koperasi yang kehabisan modalnya untuk meminjamkannya modal terhadap para anggotanya yang mengakibatkatkan banyaknya koperasi yang bangkrut/ketiadaan dana.

Saran untuk Undang-Undang No. 17 Tahun 2012 perkoperasian: Harus di tumbuhkannya kembali dari kemandiririan anggota koperasi  sehingga tidak bergantung pada pemilik modal yang besar saja, Adanya perhatian khusus terutama dari pemerintah terhadap koperasi yang terutama sedang mengalami kesulitan dalam hal modal, di bukanya kembali tentang uu koperasi produksi untuk . kegiatan usaha pelayanan di bidang pengadaan sarana dan pemasaran dalam produksi.

PASAL 1 Pasal 1 Ayat ke-13 s/d 16 , adanya usaha Simpan Pinjam didalam koperasi dapat memudahkan para anggotanya yang sedang membutuhkan uang untuk melakukan Pinjaman ke koperasi dengan dengan jangka yang ditentukan dan membayar jasa. Uang jasa dari Peminjaman tersebut dapat bermanfaat juga untuk kelangsungan berdirinya Koperasi.
PASAL 55
Pada Pasal 55 ayat ke-1 , dijelaskan bahwa Pengurus dipilih dari orang perseorangan, baik Anggota maupun non-Anggota. ini merupakan masalah apabila pengurus koperasi itu dipilih yang asalnya non-Anggota atau bukan dari anggota koperasi itu sendiri, bentuk koperasi adalah sebuah organisasi yang seharusnya anggota yang ada didalamnya mampu mengurus dan mengatur organisasinya sendiri.
PASAL 69
Pada Pasal 69 ayat ke-4, Penyetoran atas sertifikat Modal Koperasi dapat dilakukan dalam bentuk uang dan/atau betuk lainnya yang dapat dinilai dengan uang.Ini sangat memudahkan bagi para anggota yang ingin menyumbangkan modal kedalam koperasi dengan benda berharga lainnya seperti tanah, kendaraan, ataupun perhiasaan dll, namun sebelumnya benda berharga harus dialihkan atas nama Koperasi yang bersangkutan setelah itu dilakukan penilaian agar memperoleh nilai pasar yang sewajarnya
PASAL 75
Pada keseluruhan isi Pasal tersebut dijelaskan bahwa koperasi dapat menerima modal dan pengikut sertaan pengelolaan usaha dari Pemerintah dan Masyarakat, yang jelas-jelas bukan dari anggota koperasi tersebut. Padahal, pengertian umum dari koperasi itu sendiri adalah sekumpulan orang-orang yang mempunyai tujuan sama, diikat dalam suatu organisasi yang berasaskan kekeluargaan dengan dengan maksud mensejahterakan anggotanya. Dari pengertian umum tersebut ada kalimat ‘’diikat dalam suatu organisasi yang berasaskan kekeluargaan’’ , jika diperhatikan Pemerintah sebenarnya bukanlah bagian dari koperasi tersebut, begitu juga dengan masyarakat luar yang tidak tergabung  dalam koperasi, kecuali masyarakat tersebut sudah bergabung dengan koperasi untuk menyumbangkan modalnya dan ikut serta dalam membangun kesejahteraan koperasi secara bersama-sama.
Kritik dan saran
kritik:
Perkembangan koperasi di Indonesia tidak menunjukan perkembangan yang bagus,kurangnya fasilitas fasilitas tempat yang menarik perhatian orang,tingkat pendidikan mereka pada umumnya masih rendah,keterampilan dan keahlian para anggota terbatas,pengurus belom bisa melaksanakan tugas dengan semestinya,masih ada anggota koperasi yang kurang pengetahuan,pengurus kadang2 tidak jujur,kemapuan pengawas koperasi kurang memadai.
Saran:
pengurus koperasi harus lebih berwawasan dan keterampilan.harus memiliki skill yang dibutuhkan untuk menjadi anggota koperasi.membikin fasilitas fasiltas yang bagus agar bisa memikat orang.harus ada pelatihan untuk anggota anggota koperasi.pengurus harus jujur dalam pengawasan koperasi terhadap orang orang,menerima anggota koperasi tidak boleh sembarangan.pendapatan penjualan tidak harus selalu naik.perkembangan koperasi di Indonesia harus lebih maju dari usaha usaha lainnya

Pengertian Koperasi Simpan Pinjam adalah didirikan bertujuan untuk memberi kesempatan kepada anggotanya untuk memperoleh pinjaman dengan mudah dan dengan bunga ringan. Koperasi simpan pinjam juga berusaha untuk mencegah para anggotanya agar tidak terlibat dalam jeratan kaum lintah darat pada waktu mereka memerlukan sejumlah uang, dengan jalan menggiatkan tabungan dan mengatur pemberian pinjaman uang dengan bunga yang serendah-rendahnya, Koperasi simpan pinjam menghimpun dana dari para anggotanya yang kemudian menyalurkan kembali dana tersebut kepada para anggotanya.
Tujuan Koperasi Simpan Pinjam
koperasi simpan pinjam memiliki tujuan untuk mendidik anggotanya hidup berhemat dan juga menambah pengetahuan anggotanya terhadap perkoperasian
Untuk mencapai tujuannya, koperasi simpan pinjam harus melaksanakan aturan mengenai peran pengurus, pengawas, manajer dan yang paling penting, rapat anggota. Pengurus berfungsi sebagai pusat pengambil keputusan tinggi, pemberi nasehat dan penjaga berkesinambungannya organisasi dan sebagai orang yang dapat dipercaya.
Menurut UU no.25 tahun 1992, pasal 39, pengawas bertugas melakukan pengawasan terhadap pelaksanaan kebijaksanaan dan pengelolaan koperasi dan menulis laporan koperasi, dan berwewenang meneliti catatan yang ada pada koperasi, mendapatkan segala keterangan yang diperlukan dan seterusnya.
Untuk manajer koperasi simpan pinjam juga seperti manajer di organisasi apapun, harus memiliki ketrampilan eksekutif, kepimpinan, jangkauan pandangan jauh ke depan dan mememukan kompromi dan pandangan berbeda. Akan tetapi, untuk mencapai tujuan, rapat anggota harus mempunyai kekuasaan tertinggi dalam organisasi koperasi. Hal ini ditetapkan dalam pasal 22 sampai pasal 27 UU no.25 tahun 1992.

Right now, police are combing through Watertown, Mass., in hopes of finding the second of two brothers from Chechnya suspected of carrying out the attack, but not before several knee-jerk, false alarms triggered by Reddit and an information-hungry media led to several other “suspects” being wrongly ID’d. How could this happen? Here, a rundown of the wrongfully accused:
1. “The Saudi national”
Age: 21
On Monday, in the immediate frenzy of the explosions, the New York Post boldly trumpeted that a “Saudi national who suffered shrapnel wounds” had been identified as “a suspect in the Boston Marathon bombing.” Yes, a 21-year-old English student who was, in fact, injured by the very bombing he was suspected of plotting.
Talking Points Memo quickly debunked the The Post‘s claim that the person being questioned was a suspect. “Honestly, I don’t know where they’re getting their information from, but it didn’t come from us,” a Boston Police Department spokesperson told TPM. The young Saudi national was later revealed to be a witness, not a suspect. The Post never apologized.
“What made them suspect him?” asks Amy Davidson at The New Yorker. “He was running — so was everyone.”

The police reportedly thought he smelled like explosives; his wounds might have suggested why. He said something about thinking there would be a second bomb — as there was, and often is, to target responders. If that was the reason he gave for running, it was a sensible one. He asked if anyone was dead — a question people were screaming. And he was from Saudi Arabia, which is around where the logic stops. Was it just the way he looked, or did he, in the chaos, maybe call for God with a name that someone found strange? [The New Yorker]

2. A high school track star

The intrepid online sleuths at Reddit had nothing but good intentions when they created a subforum to crowdsource information on the criminals behind the Boston attacks. As my colleague Keith Wagstaff wrote, “the /r/findbostonbombers subreddit is a mostly harmless rabbit hole of marked photos and amateur conjecture,” but “the problem starts when theories go viral or are adopted by the media.”
Case in point: This photo of a “suspect” standing next to another man implicated for not doing much more than wearing a backpack. Worse still, the New York Post shamelessly plastered that same image on its front page the next day, along with the guilt-drenched cover line “BAG MEN.”
The young man in question turned out to be 17-year-old Salah Eddin Barhoum, a high school track star who moved to the U.S. four years ago from Morocco. His dream is to one day run in the Olympics.
“I’m not a terrorist… I was just watching the marathon,” Salah told the Daily Mail. “I was terrified. I have never been in trouble, and I feared for my security.”

At 1.30am I called a friend to take me to the state police — I walked into the lobby and told them I thought I was wanted by the FBI. They didn’t know what to make of it.

I had my papers with me and I gave them my Social Security number so they could check me out.

They didn’t even take me into a private room. They made some calls, then said I was free to go. [Daily Mail]

3. A missing student

“Thousands of Reddit users and 4chan people spent the days after the bombing combing through every available photo and frame of video of the site of the bombings, searching for the perpetrators,” says Alex Pareene at Salon. “And they found a bunch of guys with backpacks.”
One of them was believed to be Sunil Tripathi, a Brown University student from Pennsylvania who has been missing since March 16. Tripathi allegedly left behind all his belongings, as well as a vague note that suggested a possible suicide. Says one of his friends:

Having known Sunil for years as a classmate, roommate, and friend, I can honestly say that he was one of the nicest individuals I’ve met at Brown. He has a great sense of humor and got along well with everyone. He loves to bike, play the sax, and talk about philosophy. We all hope that he is safe, wherever he is. [International Business Times]

“Who disappears — causing a well-publicized region-wide search that had already expanded beyond Providence to Boston — a month before carrying out a terrorist attack?” asks Pareene. “Wouldn’t it be smarter to act normal as long as possible, and maybe not do something that gets your picture posted all over television and the Internet before you attempt to plant a bomb in an incredibly public venue?”
Some blogs still picked up the story and ran with it. Tripathi’s name and picture were everywhere. A Facebook page, “Help Us Find Sunil Tripathi,” was soon deleted by his family after it filled up with ugly (and false) accusations.
Tripathi’s whereabouts are still unknown.
4. A mystery man

On Thursday night, gunshots rang through the MIT campus in what became a bloody shoot-out after the two actual suspects robbed a 7-Eleven. Twenty-six-year-old police officer Sean Collier was left dead. And somehow, a man named Michael Mulugeta was (falsely) reported to be involved.
The confusion came when hacker group Anonymous posted a tweet: “Police on scanner identify the names of #BostonMarathon suspects in gunfight, Suspect 1: Mike Mulugeta. Suspect 2: Sunil Tripathi.” It was retweeted nearly 3,200 times. It was also, well, wrong.
It remains unclear who Mulugeta is — or if he even exists.
“The last thing we want to become are reporters for the fugitive,” Clint Van Zandt, former FBI profiler and NBC criminal analyst, told NBC News. “That’s what I think people who tweet and post have to be careful of in the extreme and worst-case scenario. Are they giving information that would give aid and comfort to a killer? If you ask yourself that question and the answer is no, then go ahead and post it.”

Types of Clauses


There are two major types of clauses main (or independent) clause and subordinate (or dependant) clause.

Main Clause and Subordinate Clause – Comparison

He is buying a shirt which looks very nice.

The above sentence has two clauses “He is buying a shirt” and “which looks very nice”. The clause “He is buying a shirt” expresses a complete thought and can alone stand as a sentence. Such a clause is called main or independent clause.

While the clause “which looks very nice” does not express a complete thought and can’t stand as a sentence. It depends on another clause (main clause) to express complete idea. Such a clause is called subordinate or dependent clause.

 

Main or Independent Clause   

“Main (or independent) clause is a clause that expresses a complete thought and can stand as a sentence.

Examples
            I met the boy who had helped me.
            She is wearing a shirt which looks nice.
            The teacher asked a question but no one answered.
            He takes medicine because he suffers from fever.
            He became angry and smashed the vase into peaces.
In the above sentences each underlined part shows main clause. It expresses complete though and can stand as a sentence that is why a main or an independent clause is normally referred as a simple sentence.

 

Subordinate or dependent Clause

Subordinate (or independent) clause is a clause which does not express complete thought and depends on another clause (main clause) to express complete thought. Subordinate clause does not express complete idea and can’t stand as a sentence. A sentence having a subordinate clause must have a main clause.
Example
           He likes Chinese rice which tastes good.
The clause “which tastes good” in above sentence is a subordinate clause because it does not express complete thought and can’t stand as a sentence. It depends on main clause (he likes Chinese rise) to express complete thought.
Examples.
              I met the boy who had helped me.
              I bought a table that costs $ 100.
              He takes medicine because he suffers from fever.
              The teacher asked a question but no one answered.
Subordinate (or dependent) clauses are further divided into tree types,
1. Noun Phrase, 2. Adjective Phrase, 3. Adverb Phrase

Konsumsi privat, pengeluaran pemerintah, impor dan ekspor, serta investasi adalah dipengaruhi oleh ketiga variabel tersebut di dalam permintaan agregat.

Semakin membaik atau tidaknya permintaan agregat itu tergantung semakin baik atau tidaknya varibel di atas. Dan supaya perekonomian indonesia dapat berkembang sesuai keinginan masyarakat dan pemerintah maka harus mendapat penanganan yang seimbang. Hal ini dikarenakan selain permintaan agregat ada juga penawaran agregat yang meliputi pasar tenaga kerja dan teknologi atau yang kita kenal dengan IPTEK.

Seperti informasi yang lalu mengenai pertumbuhan ekonomi Indonesia di tahun 2011, saat itu menurut RAPBN 2011 diperkirakan pertumbuhan ekonomi mencapai angka 6,4% yang berarti mengalami peningkatan 0,6 persen lebih tinggi dari pada tahun 2010 yang hanya sebesar 5,8 %. Dan perkiraan pertumbuhan ekonomi di tahun 2012 – 2014 diprediksi mencapai angka antata 6,4% sampai dengan 7,7%. 

Namun seperti pada artikel sebelumnya menjelaskan bahwa prediksi ekonomi Indonesia 2013 baru akan mencapai angka 6,8%.


Dan mengenai kerangka asumsi makro ekonomi Indonesia yang diakui pemerintah selama ini selalu mempertimbangkan baik faktor eksternal maupun internal dalam penetapannya.

Faktor eksternal yang akan mempengaruhi ekonomi makro Indonesia yaitu :

  • Perekonomian global diperkirakan akan tumbuh pada level yang moderat
  • Proses pemulihan terhadap perekonomian global.

Faktor internal yang akan mempengaruhi ekonomi makro Indonesia yaitu :

  • Hutang terhadap PBB yang terus mengalami penurunan.
  • Optimalisasi terhadap anggaran belanja negara.
  • Meningkatkan kualitas pembangunan infrastruktur.

  • Terkendalinya penerapan target inflasi.

Jika dilihat dari sisi makro, nilai tukar mana uang juga merupakan salah satu variabel penting bagikondisi ekonomi Indonesia. Melemahnya nilai rupiah di beberapa waktu tersebut salah satu penyebabnya dikarenakan kondisi pasar yang tidak menentu sehingga membuat para pelaku pasar cenderung menunjukkan penurunan aktivitas pada pasar uang sehingga menyebabkan rupiah melemah.


Sebenarnya, nilai tukar rupiah masih memiliki kemungkinan untuk lebih menguat ladi dan lebih stabil lagi karena kondisi makro ekonomi di dalam negeri saat ini lebih baik jika dibandingkan dengankondisi ekonomi global. Namun ada penghalang yang mencegah rupiah untuk terus menguat, yaitu terdapat beberapa investor dari luar yang masih melepas saham pada pasar ekuiti lokal.

Meskipun sudah mengalami peningkatan dari tahun 2011 yang mencapai angka 12,49% atau sekitar 30 juta orang.
